Bank Resolution Regime in the Kingdom of Saudi Arabia: Is The Kingdom of Saudi Arabia’s Implementation of International Standards for Banks’ Resolution Enough to Achieving Some of Its Relevant Vision 2030 Objectives?

The thesis’s main contribution is in the comparative and policy transfer analysis between three main jurisdictions, the United Kingdom, the United States and the Kingdom of Saudi Arabia, a number of international and supranational organisations, and Shariah principles, with regard to the main instruments and requirements for an effective bank resolution regime, which shed the light on the regulations governing bank insolvency, in addition to public authorities’ actions before and since the global financial crisis. The main objective of the research is to address whether the adoption and application of the Financial Stability Board’s Key Attributes of Effective Resolution Regime for Financial Institutions in the Kingdom of Saudi Arabia would be in line with international best practices, fulfil its commitments towards international organisations of which it has a membership, and result in achieving Vision 2030 objectives, as well as to provide recommendations on what should be added and improved. The research aims to provide recommendations with regard to amending some of the existing regulations and regulatory structure and framework to be able to provide better protection and supervision to the banking and financial system in the Kingdom of Saudi Arabia, in addition to easing the establishment of foreign banks in the Kingdom by partially harmonising its regulation with international best practices that would be no different from those existing in other major jurisdictions in banking and finance.
